Framing Fetco's case against trademark infringement

L&A's litigation group obtained a favorable settlement for client Fetco Home Decor in its trademark infringement lawsuit against Malden International Designs, bringing the year-long case to a close.

In 2008, Fetco launched its successful line of "Eco Woods!" picture frames, which are made from renewable resources.  Fetco brought its suit in the federal district court in Massachusetts in late 2009, accusing Malden of infringing Fetco's "Eco Woods!" mark and its distinctive packaging trade dress for the frames.  Fetco sought damages for infringement, as well as an injuction to prevent Malden from further infringing Fetco's rights.  After the close of discovery, the parties reached an amicable resolution of Fetco's claims.
