DSA Detection LLC (“DSA”) is a leader in the design and development of explosive trace detection (“ETD”) consumables for use in trace detection devices at airports and other security checkpoints.  DSA had entered into a contract with Smiths Detection, Inc. (“SDI”) for the purchase of ETD consumables.  DSA provided the ETD consumables, but Smiths failed to pay the full amount owed.


L&A’s litigation team filed a federal complaint against Smiths for its failure to pay the amounts owed to DSA.  The complaint alleged that Smiths breached two contracts with DSA, breached the implied covenant of good faith and fair dealing, and engaged in unfair and deceptive practices.


Within two months of filing the complaint, L&A secured a settlement agreement for DSA that resolved the multiple claims alleged in the complaint.
