Hear from Judge Michael Fleuchaus, Technically Qualified Judge at the Unified Patent Court (UPC), for an overview of the UPC; what it does; and where it is going. In addition to topics driven by audience participation, the discussion will cover:

  • How the long-arm jurisdiction handed down in combination by the European Court of Justice (ECJ) and the UPC in 2025 informs patent strategy.
  • Claim construction at the European Patent Office (EPO) and UPC, and harmonies between them.
  • How inventive step is assessed at the UPC versus the European Patent Office (EPO), and differences from U.S. patent law.
  • How Technical Judges are involved in UPC proceedings.
  • Influences the UPC may have on U.S. patent practice.
