Bell v. Eidens (D. Mass. 21-cv-11190).

Keith Bell is a sports psychologist from Austin Texas who has worked with individual and teams on improving performances.  Dr. Bell has worked for several national and Olympic teams and speaks internationally at coaching symposiums.  He has written numerous books and articles, including a book titled “Winning Isn’t Normal” and a website bearing the same name.  Bell says that Alexandra Eidens, founder of Big Life Journal, misappropriated a passage from “Winning Isn’t Normal” on her Instagram page to promote her journal and associated business.  Bell says that Eidens had previously requested permission to use the passage, which permission had been denied.  She has since refused to admit liability or remove the posting, claiming her use was made for inspirational purposes, perhaps suggesting a fair use defense.  Bell claims willful copyright infringement and removal of copyright management information.  Judge Burroughs has the case.
