Exler v. Cedora, Inc. (D. Mass. 21-cv-11524).

German photographer Patrick Exler accuses Cedora of using one of his photographs on Cedora’s website, www.realadventures.com.  Exler says that a photograph he took of the Menara Gardens in Marrakech, Morocco, was published by Cedora as a part of their travel website’s “Best of Morocco Experience” page without Exler’s permission.  Exler says the photograph was placed on Cedora’s website in 2013, but that he did not discover the infringement until September 20, 2018.  The complaint was filed just under the three-year statute of limitations for copyright infringement, which does not begin to run in the First Circuit until the copyright holder knew or should reasonably have known about the alleged infringement.  In addition to copyright infringement, Exler further asserts that Cedora removed copyright management information from the photograph, a separate offense.  Judge Burroughs has the case.
