Fantastic SamsFranchise Corporation v. Welch Management Corporation et al. (D. Mass. 21-cv-11822).

Fantastic Sams accuses former franchisee Welch Management and its personal guarantors of continuing to operate using the Fantastic Sams trademarks following termination of the franchise agreement, as well as for breach of contract relating to the agreement itself.  Jurisdiction over the California-based defendants in Massachusetts is based on a forum selection clause in the franchise agreement.  Fantastic Sams asserts trademark infringement, unfair competition and breach of contract.
