Luxottica Group SpA v. Basic Plus, LLC et al. (D. Mass. 22-cv-30053) and Gallaghers Olde Fashion Services, Inc. et al. (D. Mass. 22-cv-30054).

Italian eyewear maker Luxottica sued Basic Plus, which runs Chicopee’s Basic Plus Mini Mart convenience store, and Gallaghers Olde Fashion Service, which runs a Sunoco gas station and convenience store in Chicopee, of trademark counterfeiting in connection with the sale of sunglasses.  Luxottica owns a variety of eyewear brands, including Ray-Ban, Oakley, and Vogue Eyewear, and operates eyewear stores throughout America, such as LensCrafters and Pearle Vision.  It says that Basic Plus of infringing its stylized “Ray-Ban” trademark and Gallaghers of infringing its Ray-Ban and Oakley trademarks by selling cheap counterfeit sunglasses bearing the mark.

Luxottica vigorously enforces its trademark rights.  The company employs investigators around the country who identify counterfeiters, and has filed 231 trademark suits in the United States since the beginning of 2009.
