Smith noted in a message to Teslarati that overall, authors and publishers of nonfiction are at an increased risk of being sued for defamation due to the nature of their work. “In this situation, either Musk or Cook could allege that the statements made in the book are false and that the false statements harmed his reputation,” Smith said.
