Decision clarifies scope of inter partes review estoppel
Co-Founding Partner John N. Anastasi was featured in an article by Pat Murphy for Massachusetts Lawyers Weekly, analyzing a significant Federal Circuit decision that clarifies the scope of inter partes review (IPR) estoppel in patent law.
The case, Ingenico Inc. v. IOENGINE LLC, addressed a fundamental question that had divided U.S. District courts nationwide regarding when IPR estoppel applies to prevent parties from asserting certain grounds to invalidate patents in federal court. The Federal Circuit’s ruling establishes a uniform national standard, resolving confusion that had plagued patent practitioners.
John provided his insights, welcoming the Federal Circuit’s clarification, and emphasizing the practical benefits for patent practitioners. “There’s clarity here,” he noted. “As a practitioner, I like clarity. Dealing with an IPR on either side [of a case] and having to worry about whether I might have an IPR estoppel issue and it being unclear is not a world I like to practice in.”
